FAQ: What's the problem with your mom's names?

Question
You said that you have to register your mom's marriage with RO and change her name on your birth cert because she left out one of her middle names. I have to do the same thing for my daughter because her middle name appears on one document and not another. The Romanian consulate said they are very strict about the names being exact.

Answer
Yes, they're very strict. Her name is just a little different. Basically an Americanised version of her Romanian name. They're been really strict with my mom. She changed her name, the arrangement of it and then got married. So we have to go throught the whole process.

Basically, they're denying that she's still a citizen, even though she is. She never gave it up and besides, the Romanian constitution says my mother can't give up Romanian citizenship, becuase it was required by birth. We're thinking about getting a lawyer.

Giving Up Romanian Citizenship
So according to Romanian law, This is from EICEE. The Romanian embassy in Israel also has lots of information.

(1) Romanian citizenship can be acquired, retained or lost as provided for by the organic law.
(2) Romanian citizenship cannot be withdrawn if acquired by birth.

Update on my mom's name change on US docs

Just got confirmation about the name changes. It will take seven months from the date they sent the letter, so hopefully in September we'll have the name change on her US marriage cert and my US birth cert.

FAQ: Can I get Romanian citizenship through my children?

Hi Naturegirl,
My daughter can become a Romanian citizen immediately through her father. Can I become a citizen or resident through her?

Answer
I don't think so, but you can through marriage. You have to live there for three years though and pass tests in Romanian history, Romanian culture, and the Romanian language.

FAQ: Do you need to speak Romanian to become a citizen?

I heard there were talks about not granting citizenship to foreigners anymore unless they can speak Romanian, or prove that they intend to learn it, is that true?

Answer
If a foreigner is with no blood ties to Romania is trying to gain citizenship, then yes. If an ex-Romanian citizen is trying to regain citizenship, then yes. If a child of a Romanian citizens is trying to get citizenship, then I don't think knowledge of Romanian is necessary.

Changing my mom's marriage cert and my birth cert

We just filled out the forms to change my mother's marriage certificate and my birth certificate. Bad news is that it can take up to seven months.

Good news is that we found my grandfather's birth certificate, marriage license and exit papers, which prove that he's Romanian, therefore my mother is and so am I.

EDIT: February 2011, we got confirmation from the Ministry of Internal Affairs that my grandfather gave up Romanian citizenship. In order for the government to get him out of Romania, he had to give up citizenship. The process was started while he was in Romania and completed a couple months after he arrived in the US.
